Overview
This website is operated by Sarwat Art, based in Houston, Texas. Throughout the site, the terms "I", "me", and "my" refer to Sarwat Art. By visiting this site or buying something from it, you agree to these terms.
Please read them. If you do not agree to them, please do not use the site.
Buying original artwork
Every piece offered on this site is an original, one-of-one hand-painted work. Nothing here is a print or a reproduction unless it is explicitly described as one.
Because each piece is unique:

Once a piece sells, it is gone. It cannot be ordered again, though a piece in a similar spirit can often be commissioned.

Colour appearance varies between screens. I photograph my work as faithfully as I can, but no photograph fully captures heavy texture, gold leaf, or resin. If exact colour matters to you, email info@sarwatart.live and I will send additional photographs, texture close-ups, or a mock-up of the piece on your own wall before you buy.

Small variations in texture, edge finish, and surface are inherent to hand-made work. They are not defects.
Measurements given are the dimensions of the piece and are accurate to within roughly half an inch.
Prices and availability
All prices are in United States Dollars. I may change prices at any time without notice, but a change will never affect an order you have already placed and paid for.
I try to keep availability accurate, but if a piece sells in person or through another channel at the same moment you order it online, I may have to cancel your order. If that happens I will contact you immediately and refund you in full.
I reserve the right to refuse or cancel any order, and to limit quantities.
Payment
Payment is taken in full at checkout. By providing payment details you confirm that you are authorised to use that payment method and that the information you have given is accurate and complete.
Your order is not confirmed until payment has cleared.
Shipping, returns, and refunds
Shipping is governed by my Shipping Policy, and returns and refunds by my Refund Policy. Both form part of these terms.
Commissions
If you commission a piece:

Design, dimensions, palette, timeline, and price are agreed with you in writing before work begins

A deposit is required to start, and is non-refundable once work has begun, because materials are bought and studio time is committed to your piece

I share progress photographs as the work develops

Because the piece is made specifically for you, a completed commission cannot be returned or refunded

Timelines are given in good faith. Hand-made work at scale does not always move to schedule, and I will keep you informed if a date slips.
Copyright
I retain the copyright to all my artwork, always, including after a piece has been sold.
Buying an original painting gives you ownership of that physical object. It does not transfer copyright. Without my written permission you may not reproduce, print, publish commercially, or make derivative works from any piece.
You are of course welcome to photograph a piece you own and share it on your own social media — I would love to see it, and a credit to @sarwatart is always appreciated.
All images, text, and design on this website are my property or are licensed to me, and may not be copied or reused without permission.
Your account and your information
If you create an account, you are responsible for keeping your password secure and for activity that happens under your account.
You agree to give accurate, current, and complete information at checkout, particularly your shipping address. You agree not to use this site for any unlawful purpose, to attempt to gain unauthorised access to it, or to interfere with its operation.
Third-party services
This site uses third-party services including Shopify, payment processors, shipping carriers, and Meta advertising tools. Their own terms and privacy policies govern their services, and I am not responsible for the content or practices of third-party sites linked from here.
Errors on the site
Occasionally there may be typographical errors, inaccuracies, or omissions on this site, including in descriptions, prices, or availability. I reserve the right to correct them and to cancel orders placed on the basis of an error, refunding you in full.
Limitation of liability
To the fullest extent permitted by law, my total liability arising out of any purchase is limited to the amount you paid for that piece.
I am not liable for indirect or consequential losses, and I am not responsible for damage to artwork caused after delivery by improper handling, hanging, mounting, exposure to direct sunlight, or humidity. Please follow the care guidance on each product page.
Hanging large works is your responsibility. Pieces at 48 inches and above are heavy. Please have them hung using hardware and fixings appropriate to your wall type, ideally by someone who does this professionally. I am not liable for injury or damage resulting from improper installation.
Nothing in these terms excludes any liability that cannot lawfully be excluded.
Indemnity
You agree to indemnify and hold harmless Sarwat Art from any claim arising out of your breach of these terms.
Termination and severability
If any part of these terms is found to be unenforceable, the rest remains in force. These terms remain effective until terminated by either of us.
Governing law
These terms are governed by the laws of the State of Texas, United States, and any dispute will be handled in the courts of Harris County, Texas.
Changes to these terms
I may update these terms at any time. The version on this page is always the current one, and it is your responsibility to check it. Continuing to use the site after a change means you accept it.
